Touchbase is an entertainment and communication company. Our service is designed to provide friendly phone calls, greetings, reminders, and audio content for companionship and connection.

Touchbase is NOT:

A medical device or health monitoring system
An emergency response service
A substitute for professional medical care
A guaranteed alert or notification system

Do NOT rely on Touchbase for health, safety, medical, or emergency needs. While we maintain backups and strive for reliability, phone calls may fail due to network issues, carrier problems, or other factors beyond our control. If you or a loved one has health concerns, please use appropriate medical devices and emergency services.

1. Acceptance of Terms

By accessing or using Touchbase ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Touchbase provides automated phone calls with:

Friendly greetings and messages
Daily reminders and check-ins
Audio content (news, music, audiobooks)
Simple response collection (button presses)

The Service is intended for entertainment, companionship, and maintaining social connection.

3. No Medical or Emergency Use

You acknowledge and agree that:

Touchbase is for entertainment purposes only
The Service should not be used as a health monitoring tool
Missed calls or failed deliveries do not trigger emergency responses
We are not responsible for any health, safety, or medical outcomes
You should maintain appropriate medical care and emergency plans independent of this Service

4. Service Reliability

While we strive to provide reliable service:

We do not guarantee 100% uptime or call delivery
Calls may fail due to phone networks, carriers, or technical issues
We maintain backups but cannot guarantee they will prevent all failures
Service interruptions may occur for maintenance or unforeseen circumstances

5. User Responsibilities

You agree to:

Provide accurate contact information
Obtain consent from anyone you add to receive calls
Not use the Service for any unlawful purpose
Not attempt to interfere with or disrupt the Service
Keep your account credentials secure

6. Consent for Call Recipients

By adding someone to receive calls, you represent that:

You have their permission to add them
They understand they will receive automated calls
They can request removal at any time

7. Consent & Acceptable Use

Talk to them first!

Before setting up calls for someone, please have a conversation with them about Touchbase. Make sure they understand what the calls are, when they'll come, and that they're happy to receive them. This isn't just a legal requirement—it's the right thing to do.

You agree to:

Discuss Touchbase with anyone you add before their first call
Only add people who understand and want to receive these calls
Remove anyone who asks to stop receiving calls
Use Touchbase for personal connection, not commercial purposes

If we receive complaints: If a call recipient contacts us saying they didn't consent to receive calls or don't want them, we will suspend the associated account while we investigate. We're not trying to be harsh—we just want to make sure everyone using Touchbase actually wants to be using it.

8. Subscription and Payment

Touchbase Plus is a monthly subscription service
Payment is processed by Stripe
Subscriptions auto-renew until cancelled
You may cancel at any time; service continues until the end of your billing period
We do not offer refunds for partial months
Price changes will be communicated in advance

9. Intellectual Property

All content, features, and functionality of the Service are owned by Touchbase and are protected by copyright and other intellectual property laws.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Touchbase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Health outcomes or medical emergencies
Missed calls or failed message delivery
Loss of data or service interruptions
Any damages arising from reliance on the Service for non-entertainment purposes

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Indemnification

You agree to indemnify and hold harmless Touchbase from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion.

15. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or through the app.

16. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles.
